On MSNBC with Ari Melber, Weissmann predicted the Court would likely affirm the D.C. Circuit's rejection of Trump's immunity claim. He singled out Justice Kavanaugh as unlikely to accept Trump's arguments.

What actually happened

On July 1, 2024, in Trump v. United States, the Court ruled 6-3 that former presidents have absolute immunity for core constitutional acts and at least presumptive immunity for other official acts. It vacated the D.C. Circuit's ruling. Kavanaugh joined the majority opinion in full. Weissmann later warned on air that the case was 'one vote away' from the end of democracy.
